Waiver Agreement & Terms of Use

 

GENERAL CONDITIONS OF USE

I am a Divine Sovereign Being primarily guided by my own Higher Self and Divine God Source.  I am here to receive support from the EarthStar Academy (ESA) in my process of Self Realization, but I understand that I am the captain of my own Destiny, and thus the EarthStar Academy is not responsible or liable for my process and well-being.  ESA has not been evaluated by the FDA or any other government agency.  The processes and modalities shared in ESA are never to be used in place of medical treatments administered by a professional.  Everything shared in ESA is for educational purposes and is to be used recreationally. 

 

By joining the EarthStar Academy, I agree to the following Terms and Conditions of Use.

 

CONFIDENTIALITY

By joining the EarthStar Academy membership, I acknowledge and agree that no recording of any kind is allowed within the course site or otherwise.  No content of any kind inside the EarthStar Academy may be replicated, shared or exchanged externally.  All participant information shared with the EarthStar Academy is strictly confidential and not to be shared publicly with any external parties at any time.  I acknowledge and agree that any and all information shared by other participants inside the Academy events and community spaces are to be kept confidential.

 

REFUND POLICY

I am entitled to a refund for my FIRST month of Membership to the EarthStar Academy during the duration of the first month at any time.  After the initial month, there are no refunds for my membership. The LAST month of membership may be refunded if it is charged by accident after a cancellation of membership within 3 days.

 

PERSONAL AGREEMENT

The EarthStar Academy is built on Krystic Virtues of Unity Consciousness, and is designed as a Mystery School of Self-Knowledge. We are committed to creating and fostering an environment conducive to personal growth, spiritual growth, and a life in devotion to Creation.  I understand that all aspects of the EarthStar Academy experience are intentionally curated for soul growth.  By joining the EarthStar Academy, I understand that I am provided tools and teachings for personal growth and self realization, but it is my act of implementation which create results and changes in my life.  Thus I acknowledge that I am the sole responsible creator and leader of my own life and destiny, and am responsible for the application of knowledge provided by the EarthStar Academy.  The EarthStar Academy does not guarantee results due to the personal manner of each one’s journey, and is not responsible for the integration of the teachings.  I acknowledge that I am expected to act and communicate in respectful, loving, and safe ways towards the community and the academy.  By acting in a disrespectful, divisive, ungrounded or intentionally harmful manner towards other participants, the EarthStar Academy crew or establishment, I may be removed from the course and may have access to all materials, whether online or otherwise, revoked without notice and without refund.

 

CHANGES TO THIS AGREEMENT

The EarthStar Academy reserves the right to modify all offerings listed in this Agreement when reasonably necessary or advisable. In such cases, we will use sufficient efforts to communicate such in the event of any such changes to this Agreement.

ASSUMPTION OF RISKS

I agree that I am aware and understand that the EarthStar Academy and related activities of self healing, spiritual practices, soul, psychic and energy body activations may involve risks and dangers, including but not limited to the risk of injury and psychological events. I acknowledge that I am voluntarily participating in the EarthStar Academy offerings, courses and related activities, and am aware that it is self-paced and self-led program. I freely accept and fully assume any and all of the risks and dangers involved, whether caused by the negligence of the Company, Company Representatives, or otherwise.

 

By joining the EarthStar Academy, I expressly waive and release any and all claims (“Claims”) which I have or may in the future against the EarthStar Academy and Company Representatives, including their respective affiliates, employees, agents, and representatives (collectively, the “Indemnified Parties”) on account of any injury or damage arising out of or attributable to your participation in the EarthStar Academy courses or the related activities. I agree not to commence or bring any Claims against the Indemnified Parties and I irrevocably release and discharge the Indemnified Parties from liability under the Claims.

 

The content held within the EarthStar Academy is not a substitute for professional medical advice, diagnosis, or treatment. It is intended to provide holistic, energy oriented self care education and learning. The courses of EarthStar Academy has not been scientifically evaluated and should not be used as a substitute for medical or psychiatric advice, cannot diagnose or treat any medical or psychiatric condition and does not replace care from your physician.

 

The EarthStar Academy are not composed of psychiatrists, psychologists, or medical professionals. Always consult a healthcare professional if you suspect you require medical or psychiatric treatment. If you believe or suspect you are experiencing an emergency, call 911 immediately.

 

LIMITATION OF LIABILITY

The Company’s liability with respect to its obligations under this Agreement or otherwise, whether arising in contract (including fundamental breach), tort (including negligence) or otherwise, and even if the Company has been advised of the possibility of such damages and for any and all claims arising under or in connection with this Agreement, regardless of the form of action, shall not exceed the aggregate amount of the fees that you pay hereunder.

 

In no event shall the Company be liable for any indirect, incidental, or consequential damages of any kind, including without limitation, indirect, special, punitive or exemplary damages for lost business, lost savings, lost data, and lost profits, regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or otherwise, even if the Company has been advised of the possibility of such damages.

 

GOVERNING LAW

I agree that this Agreement will be governed by and construed in accordance with the laws of Krystal Living Creation, and the laws of Ontario and the laws of Canada applicable therein, without regard to their conflict of laws principles. Should a dispute arise as a result of this Agreement, I agree to submit to the exclusive jurisdiction of the courts of Ontario and waive any jurisdictional objections to such courts. I further agree that the prevailing party in any action that arises as a result of this Agreement will be entitled to receive from the other party its reasonable legal costs.

 

ACKNOWLEDGEMENT AND INDEPENDENT LEGAL ADVICE

I have read the above terms and fully understand them. I am of the legal age of majority in my jurisdiction and am authorized to grant the permissions, waivers, and releases set forth above. I have sought or hereby waive the opportunity to seek independent legal advice prior to accepting the terms of this Agreement.
